How to Discuss the Topic of a Prenup

Informing your significant other that you will need a prenuptial agreement is often scarier in theory than it is in practice. However, approaching the issue in the proper manner can help not only in aiding both people to come to terms with the presence of a prenuptial agreement, but can be the beginning of an exercise that allows a couple to pinpoint their desires and goals arising out of a potential marriage.
Earlier is better. To avoid making your spouse feel as though they have been misled, raise the issue of the prenuptial agreement early in a relationship. If you’re having any discussions about marriage, no matter how informal, you should use the opportunity to raise the issue of a prenuptial agreement. This prevents your potential spouse from feeling that you have misled them, or that you are ambushing them.
Make it about them. Even if you are the one who needs the prenuptial agreement, ask your spouse what things they would like to include. The agreement then becomes a shared enterprise, reflecting both people’s intention, rather than a one-sided manifesto.
Stay away from ultimatums. “A prenuptial agreement is necessary for me” is a gentler way to tell your future spouse “I won’t get married unless you sign a prenuptial agreement."
Use it as a springboard. Many divorces are the product of disputes about finances. The topic of a prenuptial agreement can help generate frank discussions about financial goals and fears. Have open discussions with your soon-to-be spouse about how your finances work, how they are structured, and what causes you consternation. Your spouse will have a better understanding of what makes you tick and will be more aware of how you can work together to overcome obstacles.
